Agreement to Terms

By using our website or engaging with our AI demo service, you agree to these terms. If you disagree, you must cease using our services immediately.

Service Use

Our website provides access to an AI-powered demonstration of automated customer support via phone call. This demo is strictly for evaluation purposes.

SMS Opt In and Communications

Upon explicitly consenting via our website form, you agree to receive SMS messages related exclusively to your demo, invoices, meeting reminders, or scheduling follow-ups.

Message frequency varies. Message and data rates apply. To stop messages, reply STOP; for assistance, reply HELP.

Third-Party Service Access

Tenacious Automation may integrate with third-party platforms such as Google Drive, Google Sheets, Make.com, and n8n to deliver automation and AI-powered services. Customers are responsible for granting and maintaining any required permissions for their accounts.

If you revoke access to third-party services such as Google Drive, your connected automations will stop working. Tenacious Automation is not liable for service interruptions caused by revoked access, expired tokens, or misconfigured customer credentials.

Customer Responsibility for Permissions

Any access to a customer's Google Drive or other third-party accounts is performed only with the customer's explicit authorization. These connections remain under the customer's control and may be revoked at any time. Customers acknowledge that revoking such permissions may disable or limit their automation features.

Retainer and Build Costs

Monthly Retainer Coverage: For business models that include a monthly retainer fee, the retainer covers ongoing maintenance, technical support, system updates, and upgrades for existing deployed systems. The retainer does not cover the development of new systems or features outside the original scope.

New System Builds: If a customer requests the development of a new AI system or significant new feature during an active retainer period, such work constitutes a separate project and will be billed with its own build costs in addition to the ongoing retainer fee.

Retainer Carryover: When a new system is built during an active retainer period, the existing monthly retainer will carry over and expand to cover ongoing support and maintenance for all systems, including the newly built system. The retainer ensures continuous support across your entire suite of deployed solutions.

Customer Responsibility for Operational Costs

For the "Build, Maintain, Upgrade, and Host" business model, while Tenacious Automation handles all development, maintenance, and technical management, the customer remains financially responsible for the following operational expenses:

  • Hosting Fees: Costs associated with cloud hosting services, server infrastructure, and related hosting expenses required to run the AI systems.
  • API Costs: Charges incurred from third-party API services, including but not limited to AI model APIs, communication services, data processing services, and integration platforms.
  • Infrastructure Expenses: Additional infrastructure costs such as database services, storage solutions, bandwidth usage, and other technical resources necessary for system operation.

These operational costs are separate from and in addition to any retainer fees or build costs. Tenacious Automation will provide transparent reporting of these expenses, but the customer is responsible for direct payment of all such operational costs to the respective service providers or via reimbursement arrangements as agreed upon.

Data Privacy

  • Your personal information, including phone number and email, will only be collected upon your consent, specifically when scheduling follow-up meetings.
  • Your data is securely stored, handled confidentially, and deleted immediately after your appointment unless further contact is requested.
  • We never sell or share your mobile information or opt-in consent data with third-party marketers or affiliates.

Demo Calls and Meetings

Demo calls are for demonstration purposes only. Scheduling a follow-up is optional, and you are under no obligation to do so. Consent to receive SMS communications is also not required to use our demo service.

Acceptable Use

You agree not to misuse the demo or our services, engage in fraudulent activities, or attempt unauthorized access to our systems or data.

Liability

Tenacious Automation provides services "as is" and makes no guarantees regarding their uninterrupted availability or accuracy.

Modifications

We reserve the right to update these terms. Continued use after any changes signifies acceptance of the updated terms.
